
Los taxistas de servicios precontratados consideran que supone «una limitación» a su actividad en el aeródromo
Un grupo de aproximadamente 60 taxistas autónomos que ejercen servicios concertados o precontratados ha presentado un recurso contencioso administrativo contra el acuerdo de la junta de gobierno del Ayuntamiento hispalense del turno rotatorio en la parada de taxis del aeropuerto; que se suma al recurso inicial de la cooperativa SevillaQualityTaxi avisando de que la inclusión de los taxis con servicio concertado en dicho turno «vulnera» el principio de libertad de empresa y el Reglamento de Transporte Público de Viajeros/as en Automóviles de Turismo.
El nuevo recurso ha sido asumido por el Juzgado de lo Contencioso Administrativo número uno, mientras en el caso del recurso inicial de la cooperativa SevillaQualityTaxi, está siendo tramitado por el Juzgado de lo Contencioso Administrativo número 12 de Sevilla.
En su recurso, recogido por Europa Press, SevillaQualityTaxi expone que «el establecimiento de un turno rotatorio para las paradas del aeropuerto, sin excluir a los servicios concertados o precontratados, vulnera el derecho a la libertad de empresa, dado que tales servicios son fruto de una previa contratación por el viajero o usuario, de forma que la misma resultaría frustradas de establecerse un turno de obligado cumplimiento sin tener en cuenta tal circunstancia».
Así, SevillaQualityTaxi esgrime además que «la regulación impugnada vulnera el Reglamento de los Servicios de Transporte Público de Viajeros y Viajeras en Automóviles de Turismo, aprobado por Decreto 35/2012, norma que indica de forma expresa que los servicios concertados o precontratados han de ser excluidos de dicha regulación, pudiendo no obstante establecerse paradas específicas para los mismos por parte el Ayuntamiento».
El citado decreto, según invoca expresamente SevillaQualityTaxi, determina literalmente que «en puertos, aeropuertos, estaciones, recintos feriales y eventos multitudinarios, la recogida de viajeros y viajeras se hará siempre en los puntos de parada habilitados al efecto, with the exception of the pre-contracted services for which the municipalities may establish alternative pick-up points».
TO THE COURTS
The administrative appeal, according to the municipal document issued on April 14 to report the same and collected by Europa Press, is directed «against the agreement of the government board dated 24/01/2025, approving the rotating schedule to access the taxi stands at the Seville airport during 2025 and against the presumed dismissal of the optional recourse for reinstatement filed against the same, as it relates to pre-contracted services.»
«In summary, the resolution does not take into account the exception established for pre-contracted services, which are not subject to the limitations set for the airport stands,» this group of taxi drivers points out.
In this regard, SevillaQualityTaxi has stated that it has resorted to the Administrative Litigation route, requesting precautionary measures finally not accepted, due to the alleged refusal of the local PP government to negotiate a consensual solution to this issue, given the «collateral damage» caused by not excluding pre-contracted services from the new rotating shift.
THE VOTE AT THE TAXI INSTITUTE
The measure, let us remember, was implemented since February 1, after being agreed upon by the government council of the Municipal Taxi Institute, made up of representatives from the Sevillana Taxi Union, Solidaridad Hispalense Taxi, and Élite Taxi Sevilla, as well as political groups with full representation (PP, PSOE, Vox, and Podemos-IU), technicians, and consumer representatives.
In that vote within the Taxi Institute government council, the rotating shift measure had the support of all representatives, except for those of Solidaridad Hispalense, who abstained; since previously, the National Police had arrested 26 taxi drivers, including the directors of said entity, Solidaridad, for alleged crimes of coercion, threats, damages, and criminal organization to monopolize this stand, which has its own specific rate with a fixed price ranging from 25.7 to 28.6 euros per trip.
According to the City Council, the new rotating shift system is based on the mandatory rest schedule established for taxi licenses and is structured in the four letters that group the operational licenses in the city.
THE MUNICIPAL THESIS
In this way, all license holders have access to the airport taxi stand at least four days a month, corresponding to each mandatory rest day, with the possibility of enjoying up to seven additional days, distributed equitably throughout the year. During the summer holiday period, three letters will alternate every fortnight to reinforce the service at times of high demand. This rotating shift also applies to those taxis with contracted services, now the subject of litigation.
«This model ensures a fair and balanced rotation that will allow all taxi drivers to work at the airport proportionally, ensuring service to travelers at this stand without causing harm to the rest of the city,» said the Mobility Councillor, Álvaro Pimentel.
